When the guns were to be delivered to the sheriff's department, they were intercepted and taken to Slusser's house instead, the U.S. attorney says.
The indictment alleges that there were 74 machine guns acquired illegally.
Apparently, the machine guns were broken down and the parts were sold.
Kumstar sent the letter of intent to purchase 50 fully automatic handguns for use by the Lake County Sheriff's Department in a letter dated Dec. 22, 2008 on Lake County Sheriff's Dept. paper.
Four parts from that order were recovered in Canada.
The FDA is involved in the investigation because they oversee all lasers, including those on weapons. Ninety-two laser sights were acquired and sold online.
U.S. attorney says Sheriff John Buncich and his staff have been cooperative and helpful with the investigation.
A man in Mississippi got in a shootout and the law enforcement there searched his residence and found some of the laser sights from that purchase.
County three is against Slusser for false tax reports. Count four is also against Slusser. Count five is a tax offense against Kumstar and Count six is a tax offense against Kabella.
Slusser, Kumstar and Kabella were all accused of under-reporting their income in 2009.
All three have agreed to plead guilty to all counts.
They will be making public statements in the coming days.
