Beats having to make an informed opinion,doesn't it? Rolling Eyes 

Before he gets all lathered up I'll present a few facts....
1)The GOP was pressing for the WH to do "everything it could" to get Bergdahl home.  Of course now that Obama did it,they're naturally up in arms about it. Twisted Evil 

2) GW Bush released 500+ prisoners during his term. Counting these 5,Obama has released 8.

3) With the war winding down these guys would have to have been released anyway,probably by Jan 2015.

Unfortunately those facts will be ignored by the slugs on the right and all we'll hear now for months on end is how bad Obama is. Meat puppets on Fox are referring to them as "the dream team".  Look for cries to impeach him soon,if not already.

The bottom line is simply this...On Planet Wingnuttia whatever Obama does is wrong. If Obama discovered a cure for all cancers tomorrow,instead of praising him,they would immediately claim it was a job-killer because some workers would no longer be needed.
some people working in the field of Oncology would no longer be needed.

Here’s a closer look at the five Taliban commanders released in exchange for Bergdahl:
Abdul Haq Wasiq
Thought to be in his early 40s, Wasiq served as the Taliban deputy minister of intelligence and “had direct access to Taliban and Hezb-e-Islami Gulbuddin leadership,” according to an internal memo that assessed risk at Guantanamo. He reportedly used his office to support Al Qaeda “and to assist Taliban personnel elude capture.” He also reportedly arranged for Al Qaeda personnel to train Taliban intelligence staff. Wasiq belongs to the Khogyani Tribe and began his religious training under his father, Muhammad Saleem, who died in 1981.Three years later, he went to study Islam at Warah, a school located on the Afghanistan-Pakistan border near the Khyber Pass. When the Taliban assumed control in Afghanistan, a number of Islamic students, including Wasiq, went to Kabul. Wasiq has been accused by Human Rights Watch of mass killings and torture. According to a report by the Joint Task Force Guantanamo, Wasiq “arranged for Al Qaeda personnel to train Taliban intelligence staff in intelligence methods.”
Mullah Norullah Noori
As a senior Taliban military commander, Noori has been described in government reports as a military mastermind of sorts who engaged in hostilities “against U.S. and Coalition forces in Zabul Province.” Noori, who is estimated to be around 46 or 47 years old, has developed close ties to Taliban leader Mullah Omar and other senior Taliban officials, according to a JTF-GTMO report. Noori, who was named as the Taliban governor for the Balkh and Lagman provinces, is wanted by the United Nations for war crimes including the murder and torture of thousands of Shiite Muslims. Noori has been able to remain a “significant figure” to Taliban supporters and sympathizers. According to government records, which are based on conversations with Noori, he grew up in Shajoy where he learned to read and write at a mosque in his village. His father was the imam at the mosque. As a boy, he worked as a farmer on his father’s land. In March 1999, he traveled to Kabul where he met with Mullah Yunis, the commander of the Taliban security base, and expressed interest in joining the Taliban. After the Taliban front lines fell in November 2001, Noori traveled to Konduz where he was trained and worked with Omar. Noori has been implicated in the murder of thousands of Shiites in northern Afghanistan. When asked about the killings, Noori “did not express any regret and stated they did what they needed to do in their struggle to establish their ‘ideal state.’”
Mullah Mohammad Fazi
As the Taliban’s former deputy defense minister, Fazi was held at Guantanamo after being identified as an enemy combatant by the United States. Fazi is an admitted senior commander who served as chief of staff of the Taliban Army and as a commander of its 22nd Division. He’s also wanted by the United Nations on war crimes for the murder of thousands of Shiite Muslims in Afghanistan.  According to documents, Fazi “wielded considerable influence throughout the northern region of Afghanistan and his influence continued after his capture.” The Taliban has used Fazi’s capture as a recruiting tool. “If released, detainee would likely rejoin the Taliban and establish ties” with other terrorist groups, the Guantanamo report says.
Mullah Khairullah Khairkhwa
Khairkhwa is the former governor of the Herat province and has close ties with Usama bin Laden and Mullah Omar.  According to the Joint Task Force Guantanamo file, Khairkhwa “represented the Taliban during meetings with Iranian officials seeking to support hostilities against US and coalition forces.” Khairkhwa and his deputies are suspected of being associated with an extremist military training camp run by the Al Qaeda commander Abu Musab al Zarqawi, who was killed in 2006. U.S. authorities have also accused Khairkhwa of becoming a powerful opium trafficker.
Mohammad Nabi Omari
As a senior Taliban leader, Nabi Omari has held multiple leadership roles in various terror-related groups. Pre-9/11, Nabi, who is estimated to be in his mid-40s, worked border security for the Taliban – a position that gave him “access to senior Taliban commander and leader of the Haqqani Network, Jalaluddin Haqqani,” according to the JTF-GTMO report. Born in the Khowst Province of Afghanistan, Nabi Omari and his family were forced to resettle as refugees though In Miram Shah, Pakistan after the Soviet Union’s occupation in Afghanistan. In the late 1980s, Nabi Omari returned to Afghanistan where he fought with the mujahideen against the Soviets. During the early 1990s, he ping-ponged between Taliban-related positions and others, including a stint as a used car salesman. In August 2002, Nabi reportedly helped two al Qaeda operatives smuggle missiles in Pakistan. The weapons were smuggled in pieces and the plan was to reassemble the missiles once all of the pieces had been brought across. Nabi was caught in September 2002 and eventually moved to Guantanamo.

And? They weren't terrorists. They're soldiers doing what soldiers do during war and were being held as prisoners of war. They were already being returned in a few months as soon as it was over, like we do at the end of every war. The only thing that really happened is they're getting released early to get one of our own back, which is absolutely nothing new.

Yet another manufactured controversy.

Exactly right!

Now suppose that Bergdahl had been murdered or died in captivity. The same jagoffs that are now criticizing Obama would be in full fake outrage mode,defending Bergdahl to their last breath. His death would be immediately linked to Benghazi and Fox meat puppets would be rolling out a red carpet for his parents instead of attacking them and insinuating that they a Muslim jihadist sympathizers like they're doing now.

New York Times: Classified Military Report Does Not Conclude Bergdahl Deserted
The latest New York Times article on Sgt. Bowe Bergdahl contains descriptions of a classified military report on the investigation into his disappearance, and it seriously undercuts some important pieces of the right wing smear campaign: Bergdahl Walked Away Before, Military Report Says.

The headline makes the first point: Bergdahl reportedly had walked away from his post on two previous occasions, and then returned — and his unit never reported or reprimanded him for it. This strongly argues against deliberate desertion, and in fact according to the Times the classified report does not conclude that Bergdahl deserted — although it does conclude that his unit had severe disciplinary problems.

And that letter Bergdahl was supposed to have left behind when he walked off, saying he was deserting because he was disillusioned with the mission? The military’s report apparently makes no mention of such a letter.

He declined to comment because the story was false, of course, and wingnuts never admit things like that.

UPDATED: The GOP is Heading for a World of Hurt on Bergdahl, here's why

Since I posted the comment, there have been a few developments that even add MORE to my argument. So, without further ado....

As the actual FACTS start coming out about Bowe Bergdahl, here is what we know:

1. Bergdahl had left his base without permissions on at least one prior occasion, and had come back! This is according to a report in the Army Times. In fact, his fellow soldiers failed to report it at the time. The implications of this are huge. It means that it would be impossible to prove desertion under UCMJ Article 85, because you cannot prove he intended to leave permanently. Specifically, that article states:

(a) Any member of the armed forces who–

       (1) without authority goes or remains absent from his unit, organization, or place of duty with intent to remain away therefrom permanently;

       (2) quits his unit, organization, or place of duty with intent to avoid hazardous duty or to shirk important service; or

       (3) without being regularly separated from one of the armed forces enlists or accepts an appointment in the same or another on of the armed forces without fully disclosing the fact that he has not been regularly separated, or enters any foreign armed service except when authorized by the United States; is guilty of desertion.
The only two provisions that remotely could be applicable to Bowe Bergdahl are subsections (1) and (2). The first one is eliminated by the fact that he had done this before. Given that he returned on the prior occasion, it would be extremely difficult to prove an intent to "remain away....permanently." The second subsection is also difficult to prove if he left his base at night, when he was not otherwise on duty. So, as a consequence, you can pretty much rule out Bergdahl being charged with "desertion." At worst, he can be charged under Article 86: Absence Without Leave. That is a far less serious charge, and "time served" as a POW of the Haqqani network would probably be deemed sufficient punishment. Which, incidentally, would also considered an extenuating circumstance under that article.

UPDATE: The 35 page classified Army report (as reported to the New York Times) that was compiled 2 months after Bergdahl disappeared, concluded that he had left his unit twice, not once. And the Army blamed lax security practices and a lack of discipline. Moreover, the supposed letter he left confessing to everything was not mentioned in the report at all.

2. According to the now famous article by Michael Hastings about Bergdahl,  his unit was basically a bunch of undisciplined fuck ups who went out on patrol without helmets, lost weapons, totally lacked morale and respect for military authority, etc. At least two commanders were actually demoted! So, you have to take with a grain of salt the accusations being made against Bergdahl by these people. Especially now that we know they failed to report Bergdahl left the base without permission on a prior occasion, and are still telling the media that he is a "deserter" when they know damn well that's not true.

3. The New York Times has also reported that it is almost impossible to attribute the losses the unit suffered to Bergdahl, or looking for Bergdahl. Given the lack of unit discipline, etc. One wonders whether Bergdahl is being scapegoated by these people, who were drummed up by GOP political operatives. You don't want to minimize the pain of the families of the lost soldiers. But, frankly, there is a tremendous amount of misinformation being pushed. And, a lot of speculation. It's just an unprovable allegation.

4. And, finally, Bergdahl's apparent heroism while in captivity has been almost completely ignored and glossed over. The Daily Beast originally reported that Bergdahl lulled his captors into believing he was sympathetic to them, and when they let their guard down he escaped for 3 days. When they finally found him in a hand-dug trench he covered with leaves, he was nearly naked an exhausted. Yet, it took 5 Taliban to subdue him as he fought back trying to avoid being recaptured.

Just last night, we found out that he escaped not once, but twice! Because of this, his captors kept moving him around and kept him under tight wraps. This made it exceedingly difficult and risky to attempt a rescue mission.

And, finally, the infamous "ashamed to be an American" e-mails that numbnuts like Sarah Palin keep using to attacking Bergdahl, were actually quite patriotic in context. He was complaining about the low caliber of person he had to suffer through in his unit, and how crappily they treated the Afghans (In one case, he said they indifferently ran over a child with a truck!). He was ashamed of the way the military operated there.

He was not expressing a desire to join the Taliban. He felt sympathy for the Afghan civilians who were being mistreated and abused by both sides. (These e-mails were reported in Michael Hastings' profile pieces).

When all is said and done, and Bergdahl is allowed to give his side of the story, the Republicans and Conservatives who were attacking him are going to regret it.

One other point on this that I didn't address in my comment. All of the crazy rightwingers who are suggesting that Bergdahl be executed for desertion are even more batshit crazy than it might seem at first. Even if he WAS guilty of desertion (a proposition which is extremely doubtful at this point), only one U.S. service member has been executed for the offense since the Civil War! That man was Pvt. Eddie Slovik during World War II. In his case, he signed a confession -- over the objections of his commanders! - and was defiant of military authority. Eventually, Dwight Eisenhower authorized his execution to set an example.

Moreover, in 1974 President Gerald Ford signed a conditional amnesty for Vietnam War deserters, if they agreed to two years of public service in some other capacity.

And, finally, the lone soldier convicted in connection with the My Lai massacre of Civillian Vietnamese villagers during Vietnam -- Lt. William Calley -- had his sentence reduced to House arrest and then finally commuted to time served by President Nixon after 3 years.

And, to make this even more pertinent, Staff Sgt. Robert Bales, who plead guilty to murdering 16 Afghan Civilians in their homes, was sentenced to life in prison without possibility of parole.

In other words, the batshit rightwingers want to impose a sentence on Bowe Bergdahl that is a) unsupported by any evidence; b) hasn't been imposed on a US Soldier in 70 years, and only once in 140 years; and c) more harsh than what was imposed on convicted mass murderers of civilians.

So maybe now they’ll decide that all the personal attacks on Bergdahl have outlived their usefulness. The administration’s opponents have every right to argue, if they choose, that those five Taliban are history’s most terrifying super-villains, and we shouldn’t have made the deal even to get back Audie Murphy. But now that we’re getting a fuller picture of what a troubled soul Bergdahl was, conservatives may decide that there isn’t much margin left in attacking him, lest they end up looking (for the umpteenth time) like they’ve overplayed their political hand and been blinded to everything, even human compassion, by their hatred of this president.

But if they go the supervillain route, a) why weren't they actually charged with anything despite being in custody since 2002 and ensuring we can actually keep them in custody after ending the war, and b) where was the condemnation for one of our close allies when they released 1,000 of such soldiers in a similar exchange?
